This Privacy Policy explains how FELAR (“we,” “us,” “our”) collects, uses, shares, and protects information when you use our website, storefronts, marketplace, and related services (the “Platform”).
This is a general-purpose template and is not a substitute for legal advice. Have a qualified lawyer review this before publishing — in particular to confirm compliance with Nigeria's Data Protection Act (NDPA) and any other data protection laws applicable to where your users are located (e.g., GDPR if you serve EU/UK users, CCPA if you serve California residents).
1. Information We Collect
1.1 Information you provide directly
- Account information: name, email address, password, account type (producer or artist), profile bio, avatar/profile photo.
- Storefront and listing information: product titles, descriptions, artwork, audio files, pricing, license terms, service offerings.
- Payment and payout information: billing details processed through our payment provider (currently Paystack); bank account or payout details for sellers. FELAR does not store full card numbers or bank credentials directly — these are handled by our payment processor.
- Communications: messages sent through the Platform's messaging system, support requests, dispute submissions.
- Identity verification information: where required (e.g., for payout eligibility or fraud prevention), government-issued ID or business registration details.
1.2 Information collected automatically
- Usage data: pages viewed, storefront visits, search queries, click activity, referral source.
- Device and log data: IP address, browser type, device type, operating system, timestamps.
- Cookies and similar technologies: used for authentication (keeping you signed in), analytics, and remembering preferences. See Section 7.
1.3 Information from third parties
- Payment confirmation and transaction status from Paystack (and other payment processors as added).
- Authentication data if you sign in via Google or Apple (name, email, profile photo as permitted by your settings with that provider).
2. How We Use Information
We use the information we collect to:
- Create and maintain your account and storefront.
- Process transactions, generate license documents, and facilitate payouts.
- Provide customer support and resolve disputes between buyers and sellers.
- Send transactional communications (order confirmations, payout notifications, security alerts).
- Send product updates or marketing communications, where you have opted in (you can opt out at any time).
- Monitor, detect, and prevent fraud, abuse, and violations of our Terms of Service.
- Analyze usage patterns to improve the Platform (e.g., which features are used, page performance).
- Comply with legal obligations, including tax reporting and anti-money-laundering requirements tied to payment processing.
We do not sell your personal information to third parties.
3. Legal Basis for Processing (where applicable)
Where data protection law requires a legal basis for processing (e.g., under GDPR or the NDPA), we rely on:
- Contractual necessity — to provide the Platform and process transactions you request.
- Legitimate interest — to secure the Platform, prevent fraud, and improve our services.
- Consent — for optional marketing communications and non-essential cookies, which you may withdraw at any time.
- Legal obligation — for tax, financial reporting, and compliance with law enforcement requests where legally required.
4. How We Share Information
We share information only in the following circumstances:
- With payment processors (e.g., Paystack) to process payments and payouts.
- With other users, as necessary for the transaction — e.g., a buyer's name/email may be visible to a seller for order fulfillment and license issuance; a seller's storefront information is public by design.
- With service providers who help us operate the Platform (hosting, email delivery, analytics, customer support tools), under contractual obligations to protect your data and use it only for the purposes we specify.
- For legal reasons — where required to comply with a subpoena, court order, or other legal process, or to protect the rights, property, or safety of FELAR, our users, or the public.
- In connection with a business transaction — such as a merger, acquisition, or sale of assets, where user information may be transferred subject to this Policy (or a materially similar one).
5. Data Retention
We retain personal information for as long as your account is active or as needed to provide the Platform. After account closure, we retain certain information as required to:
- Comply with legal, tax, and accounting obligations (typically 6–7 years for financial transaction records).
- Resolve disputes and enforce our agreements.
- Prevent fraud and abuse.
Storefront content and listings are removed from public view upon account closure, though purchased license documents remain accessible to buyers who bought them.
6. Your Rights
Depending on your location, you may have the right to:
- Access the personal information we hold about you.
- Correct inaccurate or incomplete information.
- Request deletion of your personal information, subject to our legal retention obligations (see Section 5).
- Object to or restrict certain processing (e.g., marketing communications).
- Request a copy of your data in a portable format.
- Withdraw consent where processing is based on consent.

If you are located in the EU/UK, you also have the right to lodge a complaint with your local data protection authority. If you are located in Nigeria, you may contact the Nigeria Data Protection Commission (NDPC).
7. Cookies and Tracking Technologies
We use cookies and similar technologies for:
- Essential functions: keeping you signed in, remembering cart contents, security (CSRF protection).
- Analytics: understanding how the Platform is used, in aggregate, to improve it.
- Preferences: remembering display settings (e.g., currency, language where supported).
Where required by law, we will present a cookie consent banner allowing you to accept or reject non-essential cookies. You can also manage cookies through your browser settings, though disabling essential cookies may affect Platform functionality.
8. Data Security
We use industry-standard measures to protect your information, including encryption in transit (HTTPS) and at rest for sensitive data, access controls limiting who at FELAR can view personal or payment information, and regular security review of our infrastructure providers. No system is completely secure, and we cannot guarantee absolute security of information transmitted to or stored on the Platform.
9. International Data Transfers
FELAR's infrastructure providers may store or process data in countries other than your own. Where we transfer personal information across borders, we take steps required by applicable law (such as standard contractual clauses under GDPR, where relevant) to ensure it remains protected consistent with this Policy.
10. Children's Privacy
The Platform is not directed at individuals under 18 (or the age of legal majority in their jurisdiction), and we do not knowingly collect personal information from children. If we learn that we have collected information from a child without appropriate consent, we will delete it promptly.
11. Third-Party Links
The Platform may contain links to third-party websites or services (e.g., a seller's social media links, payment processor pages). We are not responsible for the privacy practices of third parties, and we encourage you to review their privacy policies separately.
12. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be communicated via email or an in-app notice before taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Policy.

This template covers common data-collection scenarios for a marketplace/payments platform but is not exhaustive. Before publishing, have a lawyer confirm: (1) compliance with Nigeria's Data Protection Act given your primary user base, (2) whether GDPR or other frameworks apply based on where your users are located, (3) accurate retention periods for your specific tax/legal jurisdiction, and (4) that this Policy accurately reflects your actual data practices once the product is built — a privacy policy must match what the product actually does, not just what's planned.
